I-Terms and conditions for sale of goods online

 

All orders placed using this site http://www.mellysdesign.com, assume the customer’s acceptance of these general terms and conditions.

The brand, Mellys D. sells its products by online sales on this site.

Conditions of sale are subject to change; if this occurs, the conditions in place on the date the order is placed will be applicable.

The customer has the right to save and edit these conditions of sale, however any saving and editing of this document is the entire responsibility of the customer.

The customer affirms, in ordering from this site, that the products are being acquired for their own personal use and not for use in a professional capacity.

The buyer’s rights will be waived in the case of any products from this site being used in any professional capacity or context.

Before purchasing any of our products for professional use, the permission of Mellys D. design must be sought and granted.

The client affirms that they have the legal capacity to understand and agree to these terms and conditions of sale.

Confirming an order is considered as the equivalent of an electronic signature; this has the same value as a written signature and constitutes an agreement between the buyer and the seller.

Consequently the purchaser acknowledges that they have been fully informed that their agreement to these terms and conditions of sale does not require a signature when the purchaser buys products that are offered for sale on this site.

This contractual information will be confirmed by email, at the latest, on the date of delivery, otherwise by post to the address indicated at the time of the order.

All communications saved by Mellys D. system, under proper security conditions, will be considered as proof of communication, orders and payments made between the parties. Your orders and bills are saved using secure methods and may be produced as proof in case of any doubts or disputes.

II-Order

The sale price is indicated in euros and is tax-free, as the company is exempt from vat (TVA in France).

However the sale price does not include delivery costs or any applied customs costs which will be detailed at the final stage of the order depending on the destination of the delivery.

Free delivery may apply to some items. This will be clearly stated at the time of your order.

 

WE ARE AN ECO-FRIENDLY COMPANY

Packaging costs are free for our products, and in line with our policy of being eco-responsible,

Mellys D. is committed to recycling where possible, and makes every effort to recycle all packaging materials that are used.

Where possible, we also regroup orders, to minimize the use of transportation.

DONATIVE

5% of every sale is donated to a charity dedicated to children, an overall check will be prepared at the end of the year.

All products sold on our site are the exclusive creation of the brand Mellys D., Any collaboration with other artists or craftsmen will be clearly indicated.

 

All Mellys D. products are produced by artisans in FRANCE and are unique.

This artisanal production assures a high quality and finish on all our products

 

Mellys D. products are not designed for children under 5

When products are delivered with light bulbs included this is clearly indicated on the site.
Please note that these articles are fragile and although each one is carefully tested before packaging and delivery, Mellys .Design & art shall not be liable to the Buyer for any damage or breakage arising directly or indirectly from the delivery of these Goods. No warranty can be offered regarding these bulbs as there are multiple risks involved in their transportation: electrical tension problems, handling problems, both normal and abnormal wear and tear.

·       Availability of products

The order will be fulfilled within 15 days from the day following the completion of the order.

If an ordered item is not available, the customer will be informed as soon as possible.

The customer, in this case can choose between the following options:

  1. Complete reimbursement by cheque of the sum paid, within 30 days.

  2. The choice of other products on the site for the same sum. The difference between the new order and the old will either be reimbursed by Mellys D. in the case of an order that at a lower price, or the customer will pay the difference in the case of an order for a higher price. The new order will be dispatched or the missing article reimbursed as described above.

  • Product compliance

Before being dispatched, each product is checked for its conformity to the description on the site.

However, it is possible that, due to technical issues(photographic or technological) the actual appearance of a product may differ slightly from the photographs presented on the site.

 

III-Returned goods

The right to return goods applies only to a physical person (not to companies, when an agreement for professional use of items has been agreed).

The customer has 14 calendar days to return any goods, in accordance with articles L 120-20

This period is calculated from the day the order is received.

All returns must be reported in advance by email to:

boutiquecontact@mellysdesign.com , so that the return address can be sent to the customer.

 

Only items which are sent back in perfect condition will be accepted.

They must be returned properly packaged.

They must be unused.

Any item which upon return is incomplete, damaged, used, washed, deteriorated, broken or dirty in any way will not be reimbursed or exchanged. It is advisable to reuse the original packaging when returning your order.

In the case of loss of, or damage to the returned package, the refund will not be made and the customer should make any claims directly to the transporter.

 

The return address will be sent to you by email.

 

The right of return may be exercised without penalty, with the exception of the cost of shipping.

 

In the case of returned goods, the customer may choose between reimbursement of any sums paid, and the exchange for a different product (in conformity with the explanations above).

In this case, the costs of shipping will be covered by the customer.

In all cases, the reimbursement of the sums paid will not be made until the goods have been received under the conditions mentioned above.

 

 

IV-Protection of personal information

All personal information received on our site is necessary to the fulfilment of your order. This information is reserved for internal use only and will not be shared in any way with any other parties.

 

Under the data protection act of 6 Januart 1978, regarding information technology and liberties, the customer has the right to verify, consult, modify and delete data that they have communicated to Mellys D. and this right can be exercised by sending an email to :boutiquecontact@mellysdesign.com

 

In all cases, as the Data Protection act states, the lack of response byMellys D.esign & art will have no consequences, and a simple request is sufficient for the necessary changes to be made by us.

 

V-Intellectual property

It is strictly forbidden to reproduce or use any texts, commentaries, artistic works or products from our site without written authorisation.

All data (apart from personal information from clients [IV-Data Protection Act cited above]) is the property of Mellys D. or of the named artist and is protected by COPYRIGHT and by INPI for the brand, Mellys D.

Attention : You may be subject to civil penalties and fines for any infraction of this clause.


VI-Payment options

Mellys D.esign & art reserves the right to refuse to ship any order for a customer who has not fully or partially paid for a previous order or with whom there is a payment settlement dispute pending.

 

SECURE PAYMENT

In order to ensure the safety of your payments on line, Mellys D. boutique has chosen to use PAYPAL, which is 100% safe and secure.

You may pay for your order either by bank card or by your paypal account (recommended by Mellys D.).

 

Any customer wishing to pay by cheque, should contact us by email atboutiquecontact@mellysdesign.com

The order will only be dispatched after full payment has been made and the cheque cashed.


VII-Shipping methods

Customers should be aware that certain items are not available for delivery due to their value, fragility or size. This is clearly indicated on the site and these items can be picked up by the customer (see conditions below). A reduction will be applied to these orders.

 

  • Pick-up available by appointment only

If you wish to pick up your order, you can make a request at the time of finalising your shopping basket (reductions will be applied depending on the items), then by sending an email to…. in order to make an appointment for pick-up.

Please let us know by email if you need to change an appointment time.

 

  • Advice for the customer

Items will be delivered to the address used by the customer at the time of ordering. Please follow the instruction on the site after your basket is confirmed.

The shipping address will be the one provided at this point in the transaction.

Any other address communicated in the commentary section will not be used.

 

Items are are carefully checked and packaged by our shipping service, and leave our premises in excellent condition and properly packaged. We are not responsible for any damage caused during the shipping itself.

 

The customer should check the state of the packaging and the merchandise upon receiving it and report any damage to the shipping company immediately. The customer should also inspect the items for their conformity to the order placed.

 

Mellys D. should also be informed of any damage or problems within 7 days

 

We remind our customer that Mellys D. is a cottage industry and none of our items are sold in kits or are machined.

  • Costs, time of shipping, and conditions for France, Andorra and Monaco

 

Shipping is free and your parcel will be delivered to the shipping company within 4 days of placing your order, in order to minimise the number of journeys and fulfil our commitment to being an eco-responsible company.

For France, Andorra and Monaco, all orders will be dispatched by Coliposte expert.

If you prefer delivery by Coliposte expert with required signature, an additional cost will be applied.

Please arrange to be available the day of the delivery.

In case of absence the delivery service will leave a notice of passage which allows you to pick up your parcel, or to arrange another delivery date.

Deliveries generally take between 5 and 7 days.

No delivery will be made on Sunday, or on bank holidays.

 

  • Costs, shipping times and conditions for the European union zone 1-2

 

Fixed shipping, your parcel will be delivered to the shipping company within 4 days of placing your order, in order to minimise the number of journeys and fulfil our commitment to being an eco-responsible company.

 

The deliverable countries:

Germany, Belgium, the Netherlands, Luxembourg, the United Kingdom, Irland, Italy, Spain*, Portugal*, Autria.

*except spécific territories

 

Zone 1-2, for order below 4kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 17 €.

Zone 1-2, for order between 4kg - 8 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 20 €.

Zone 1-2, for order between 8kg - 16 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 26 €.

Zone 1-2, for order between 16kg - 21 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 30 €.

Zone 1-2, for order between 21kg - 26 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 36 €.

Zone 1-2, for order between 26kg -30 Kg maximum, will be dispatched by Coliposte expert with required signature, for a flat rate of 40 €.

 

All orders will be dispatched by Coliposte expert.

The deliverable countries : Denmark, Hungary, Poland, the Czech Republic, Slovakia, Slovenia, Estonia, Latvia, Lituania, Greece, Icelande, Finland, Norway, Sweden.

 

Zone 3-4, for order below 4kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 20 €.

Zone 3-4, for order between 4kg - 8 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 30 €.

Zone 3-4, for order between 8kg - 16 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 55€.

Zone 3-4, for order between 16kg - 21Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 65€.

Zone 3-4, for order between 21kg - 26Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 80 €.

Zone 3-4, for order between 26kg - 30Kg maximum, will be dispatched by Coliposte expert with required signature, for a flat rate of 90 €.

·       Costs, shipping times and conditions for the Outside European union zone 5-6, taxes or customs charges

Fixed shipping, your parcel will be delivered to the shipping company within 4 days of placing your order, in order to minimise the number of journeys and fulfil our commitment to being an eco-responsible company.

 

The deliverable countries :

United States, Canada, China, Japan, Hong Kong, Singapore, India, Israel, Guadeloupe, Martinique, Réunion, French Guyana, Mayotte, Switzerland , Morocco, Tunisia.

 

Zone 5-6, for order below 4kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 40 €.

Zone 5-6, for order between 4kg - 8 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 70 €.

Zone 5-6, for order between 8kg - 16 Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 100 €.

Zone 5-6, for order between 16kg - 21Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 150 €.

Zone 5-6, for order between 21kg - 26Kg, will be dispatched by Coliposte expert with required signature, for a flat rate of 250 €.

Zone 5-6, for order between 26kg - 30Kg maximum, will be dispatched by Coliposte expert with required signature, for a flat rate of 300 €.

Please arrange to be available the day of the delivery.

In case of absence the delivery service will leave a notice of passage which allows you to pick up your parcel, or to arrange another delivery date.

Deliveries generally take between 15 and 20 days.

No delivery will be made on Sunday, or on bank holidays.

For deliveries outside of the European Union, any taxes or customs charges are the responsibility of the customer.

In this case, the bill will be sent with the parcel and a copy sent to the customer by email.

If there is a delay of more than 3 or 4 days in receiving your package, please contact the post office.

Mellys D.esign & art will not be responsible for any loss or delay in deliveries because of errors or disturbances caused by the shipping company (for example, full or partial strikes by the postal service or transportation and communication companies).

 

  • Shipping problems due to the shipping company

Any problems with your delivery (damage, missing items, broken items) should be immediately reported on the delivery form, accompanied by the customer’s signature. The customer should also inform us by sending a registered letter within two (2) days of the reception of the order, explaining the damage and any claims regarding cancellations or refunds.

·       Problems with deliveries

The customer must inform Mellys D.esign & art within two days of the delivery if there is an error in the order, if the item does not conform either in nature or quality to the items on the order form, or if the item does not function correctly.

Any claim made outwith this period and outside of the rules defined above, will not be considered andMellys D.esign & art will accept no responsibility for any such claims.

 

Upon receiving your claim, we will issue an exchange coupon for the item or items in question, and will send this to you by email.

Exchange of a product will only be possible after the customer has received an exchange number as described in the protocol above.

In order to consider your claim, any product returns must be declared by email to Mellys D.esign & art. The shipping costs will be paid by Mellys D.esign & art except in the case where the returned item does not correspond to the original on the return coupon sent by the customer.

If the customer does not collect the parcel within the time designated by the shipping company, the products will be returned to Mellys D.esign & art who will then inform the customer. Another delivery will be arranged with the cost of shipping paid by the customer.

Mellys D.esign & art is in no way responsible for the loss of the delivery notification by the customer.
If the delivery address given at the time of ordering is not complete, the customer must pay for a second delivery, once the address has been updated. The customer can also choose to be reimbursed for the item but the delivery costs are non-refundable.

 

  • Product returns

 

Only items that are complete and in perfect condition will be accepted

They must be properly protected and packaged.

They must show no signs of use

Any product which is returned incomplete, damaged, used, washed, deteriorated, broken or dirty, either wholly or partially, will be neither refunded nor exchanged. We strongly advise you to reuse the original packaging to return your order.

 

In the case of the loss or damage to a returned package, we will not be able to refund the customer directly and the customer should make a claim to the transporter.

The client is responsible for the shipping of the product and the costs of returning it are paid by the client.

 

The return address will be provided along with a return coupon which you should complete and attach to your parcel. Please also send a copy of the coupon to us by email.

VIII-Force majeure

Neither party will be held responsible if they fail in their contractual obligations due to unforeseeable circumstances or a case of force majeure.

Unforseeable circumstances or force majeure would include all facts or circumstances beyond the control of the parties and which could not be prevented by the parties, in spite of all reasonable efforts. The party who is affected by such circumstances should notify the other within 10 days of the event.

The two parties will have one month, except where this is impossible due to a force majeure, to come to a reasonable arrangement as to how to proceed with the interrupted orders.

If the case of force majeure lasts more than 3 months, the present conditions may be rescinded by the injured party. In short, cases of force majeure and unforeseeable circumstances outwith those usually mentioned by the law could include: a blockade of transportation systems, earthquakes, fire, storms, floods, lightning, breakdown of telecommunication systems or difficulties related to telecommunication systems outwith the control of the parties.

IX-Applicable law

The conditions set out here are subject to French law, both for the substance and form of the rules. In case of litigation or claims, the customer should first contact Mellys D.esign & art, in order to resolve the problem amicably.
